Complaint seeking adjudication by the Workplace Relations Commission under section 6 of the Payment of Wages Act, 1991 | CA-00012950-001 | 02/08/2017 |
Date of Adjudication Hearing: 09/11/2017
Workplace Relations Commission Adjudication Officer: Ewa Sobanska
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant worked as Bar Staff with the Respondent between 20th September 2016 and 17th April 2017. She worked on average 14.5 hours a week and was paid €145 gross a week. She claims that she was owed €170 in respect of holiday pay. |
Summary of Complainant’s Case:
The Complainant did not attend the hearing or provide any explanation for failure to do so. |
Summary of Respondent’s Case:
The Respondent did not attend the hearing or provide any explanation for failure to do so. |
Findings and Conclusions:
I am satisfied that both Parties were notified of the details of the hearing. As the Complainant was not in attendance to move the complaint, I find that it fails for want of prosecution. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
The complaint fails for want of prosecution. |
